1. Agreement to Terms

By accessing or using MortgageDetail ("Service"), operated by MortgageDetail.com, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

MortgageDetail is a software-as-a-service (SaaS) platform that enables mortgage professionals to create mortgage comparison presentations, including side-by-side loan comparisons, amortization visuals, and closing cost breakdowns. The Service is intended for use by licensed mortgage professionals and is not a substitute for professional mortgage advice.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account. By registering, you represent and warrant that you hold a valid NMLS license and are authorized to originate or broker mortgage loans in your jurisdiction. Use of the Service by unlicensed individuals constitutes a material breach of these Terms.

4. Subscription, Billing, and Free Trial

The Service is offered on a subscription basis at the price listed on our pricing page. Subscriptions renew automatically each billing cycle unless cancelled. You may cancel your subscription at any time through your account settings.

A 3-day free trial is available for new accounts. No credit card is required to start the trial. At the end of the trial period, your account will automatically enter a read-only state — you will not be charged, and no automatic conversion to a paid subscription will occur. To continue using the Service after the trial, you must manually upgrade to a paid plan through your account settings. During the read-only period, your existing presentations and data will be preserved but you will not be able to create or edit presentations.

We reserve the right to change subscription pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle following the notice period.

5. Cancellation and Refund Policy

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service through the end of your current billing period. No prorated refunds are provided for partial billing periods.

After your subscription ends, your account will enter a read-only state for 30 days, during which you may export your data. After the 30-day grace period, your presentation data and account content will be scheduled for permanent deletion. If you wish to export your data before deletion, contact us at support@mortgagedetail.com.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Misrepresent loan terms, rates, or costs in presentations created with the Service
  • Share your account credentials with unauthorized users
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Use the Service to transmit malware or other harmful code
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, data-mine, or otherwise extract data from the Service through automated means

7. Your Content and Regulatory Compliance

You retain ownership of all content you create or upload through the Service, including presentations, loan data, branding assets, and client information ("Your Content"). You grant us a limited license to host, store, and display Your Content solely to provide and operate the Service.

You are solely responsible for ensuring that Your Content and your use of the Service comply with all applicable federal, state, and local laws and regulations. The Service is a presentation tool only and does not validate, certify, or guarantee the regulatory compliance of any output. Without limitation, you acknowledge sole responsibility for compliance with:

  • Truth in Lending Act (TILA) / Regulation Z: including APR calculation accuracy and required disclosures
  • Real Estate Settlement Procedures Act (RESPA): including good faith estimate and closing cost requirements
  • TILA-RESPA Integrated Disclosure (TRID): Loan Estimate and Closing Disclosure accuracy obligations
  • SAFE Act / NMLS: licensing, registration, and continuing education requirements
  • CFPB Mortgage Advertising Rules: advertising and marketing disclosure requirements for mortgage origination
  • State-specific requirements: all applicable state mortgage lending, advertising, and disclosure laws in your jurisdiction(s)

MortgageDetail.com, LLC is not responsible for any regulatory violations, fines, or enforcement actions arising from your use of the Service or the content of presentations you create.

8. Recipient Tracking Disclosure Obligation

The Service tracks when and how often shared presentations are viewed by recipients and provides this information to you. By using the presentation sharing features, you agree to inform your clients and recipients that their viewing activity (including open timestamps and view frequency) is tracked and reported to you. Failure to provide such notice to recipients may violate applicable privacy and electronic communications laws.

9. Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by MortgageDetail.com, LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without our prior written consent.

10. DMCA and Copyright Infringement

We respect the intellectual property rights of others. If you believe that content available through the Service infringes your copyright, you may submit a takedown notice in accordance with the Digital Millennium Copyright Act (DMCA) by providing the following information to our designated DMCA agent:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and its location on the Service
  • Your contact information (address, telephone number, and email address)
  • A statement that you have a good faith belief that use of the material is not authorized
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

Send DMCA notices to legal@mortgagedetail.com. Upon receipt of a valid takedown notice, we will remove or disable access to the allegedly infringing material and notify the user who posted it. Users may submit a counter-notice if they believe the content was removed in error.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any calculations, projections, or analyses generated by the Service. You are responsible for verifying all loan data and calculations before presenting them to clients.

12. Limitation of Liability

To the maximum extent permitted by law, MortgageDetail.com, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Force Majeure

MortgageDetail.com, LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: acts of God, natural disasters, epidemics or pandemics, fire, flood, earthquake, war, terrorism, civil unrest, labor disputes, government actions or orders, internet or telecommunications infrastructure failures, third-party service disruptions (including but not limited to outages of our hosting, database, or payment processing providers), cyberattacks, power failures, or any other event that could not have been reasonably foreseen or prevented. During any such event, our obligations under these Terms will be suspended for the duration of the event.

14. Indemnification

You agree to indemnify and hold harmless MortgageDetail.com, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

15. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service will immediately cease. You may export Your Content before termination. Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and the arbitration clause survive termination.

16. Export Controls

You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services, and that you are not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export control laws and regulations, including the Export Administration Regulations (EAR) and sanctions programs administered by the Office of Foreign Assets Control (OFAC).

17. Dispute Resolution and Arbitration

Binding Arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the State of Florida. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver.You agree that any Dispute will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding, whether as a named plaintiff, class member, or otherwise. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, or representative proceeding.

Small Claims Exception.Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes within the court's jurisdictional limits.

30-Day Opt-Out. You may opt out of this arbitration provision by sending written notice to legal@mortgagedetail.com within 30 days of first accepting these Terms. Your notice must include your name, account email address, and a clear statement that you wish to opt out of binding arbitration. If you opt out, Disputes will be resolved in the state or federal courts located in Florida.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Subject to the arbitration provision above, any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida.
